Market access according to the EEA agreement
This AIC replaces AIC – I 09/01
According to the EEA Agreement (Agreement of 2 May 1992 on a European Economic Area), carriers licensed according to Council Regulation (EEC) No 2407/92 on licensing of air carriers may operate flights between points within the EEA and airports in Norway open for commercial air transport operations, including cabotage, without previous permission by the Norwegian Civil Aviation Authority. Reference is made to Council Regulation (EEC) No 2408/92 on access for Community carriers to intra-Community air routes and AIP Norway AD 1.3-1 and AD 1.3-2. The said market access encompasses all forms of commercial air transport between airports open for commercial air transport operations, including scheduled, charter and taxi services.
Regarding scheduled services, summer and winter programmes are to be notified to the Norwegian Civil Aviation Authority at least 14 days prior to initiation of the programme. This obligation also applies to carriers performing public service obligation according to Council Regulation (EEC) No 2408/92 on access for Community carriers to intra-Community air routes, art. 4.
Regarding charter operations, no obligation to notify has hitherto been exercised. After review by the Norwegian Civil Aviation Authority, however, it has been decided to introduce an obligation to notify such operations. The need for notification has been based on survey and control considerations, as well as information that equal practices are exercised in Denmark and Sweden. Thus, charter operations are to be notified to the Norwegian Civil Aviation Authority at least 48 hours prior to initiation of the operation(s) in question. The said time limit does not encompass Saturdays, Sundays or Norwegian holidays.
Notification regarding scheduled and charter services shall include:
- Planned route
- Flight number
- Aircraft type and registration
- Hours and days of operation
- Period of operations
Legal authority for the above obligation to notify may be found in the Norwegian Aviation Act (Act No. 101 of 11 June 1993) § 13-4.
Regarding aerial work and air transport within Norway outside airports open for commercial air transport operations, reference is made to AIC I 5/00.
Regarding scheduled flights not operated under the EEA Agreement, reference is made to AIC I 6/00.
Regarding charter flights not operated under the EEA Agreement, reference is made to AIP Norway GEN 1.2-4 ff.
