Traffic programmes for operations between Norway and states not parties to the EEA agreement

A. Concession

It is a prerequisite for approval of traffic programmes (scheduled services) between Norway and states not parties to the EEA Agreement (Agreement of 2 May 1992 on a European Economic Area) that a concession has been granted covering the traffic programme in question, ref. Act of 11 June 1993 No. 101 on aviation (Aviation Act) § 8-1. According to Norwegian practice code share is considered as utilization of traffic rights, thus requiring the grant of concession. Applications for concession should be addressed to the Civil Aviation Authority as early as possible and at the latest six weeks prior to planned commencement of the traffic programme. An application for concession should contain the following:

  1. A brief presentation of the company (date of establishment, ownership structure etc.)
  2. An overview of the aircraft fleet
  3. An overview of existing routes
  4. Planned routing
  5. Flight Numbers
  6. Planned type of aircraft to be used
  7. Hours and days of operation
  8. Period of operations

A recommendation will be submitted by the Civil Aviation Authority to the Ministry of Transport and Communications who will consider presentation of the matter before the King in Council. The Civil Aviation Authority will notify the applicant as soon as the application has been decided upon.

B. Approval of Traffic Programmes

According to the general terms of concession, traffic programmes, including code-share arrangements, are to be approved by the Civil Aviation Authority. Application for approval of traffic programmes should be filed with the Civil Aviation Authority as early as possible and at the latest three weeks prior to commencement of the traffic programme in question. If no concession has been granted that covers such traffic programme, application for grant of concession must be filed, ref A. above. An application for approval of a traffic programme should contain the following:

  1. Planned routing
  2. Flight Numbers
  3. Planned type of aircraft to be used
  4. Hours and days of operation
  5. Period of operations
